1. Acceptance of terms

By accessing or using WaterProxy’s services, website, or any associated products (collectively, the “Service”), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service.

2. Description of the Service

WaterProxy provides mobile proxy services, including mobile IP addresses on dedicated devices, for legitimate use cases such as market research, ad verification, brand protection, social media management and web scraping in compliance with applicable laws.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

4. Account responsibilities

You are responsible for keeping your account credentials, API keys, proxy credentials and rotation links confidential. You are liable for all activity that occurs under your account. You must notify us immediately of any unauthorized access or use of your account.

6. Wallet, payments and refunds

You pay for the Service from a prepaid wallet balance that you top up by card (processed by Stripe) or cryptocurrency (processed by NOWPayments). Rentals and renewals are charged from this balance at the price shown at the time of purchase. If auto-renew is on, the renewal price is charged from your balance when a rental period ends; if the balance is insufficient, the rental pauses and then ends.

Refunds are only issued if the service does not work as described or is not delivered within 24 hours of purchase. Approved refunds are credited to your wallet balance unless we agree otherwise. We reserve the right to change pricing with reasonable notice; price changes do not affect a rental period you have already paid for.

7. Service availability

We strive to provide uninterrupted service but do not guarantee 100% uptime. Mobile networks, devices and carriers can be affected by outages outside our control. We are not liable for any downtime, service interruptions, or data loss. Maintenance windows may occur without prior notice.

8. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any conduct that we deem harmful to the Service, other users, or third parties. Upon termination, your right to use the Service ceases immediately, and any remaining balance may be forfeited.

9. Limitation of liability

To the maximum extent permitted by law, WaterProxy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless WaterProxy, its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Intellectual property

All content, trademarks, logos, and intellectual property associated with the Service are owned by WaterProxy. You may not copy, modify, distribute, or create derivative works without prior written consent.

12. Modifications

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email or a prominent notice on the website.

13. Governing law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
